Last updated: 2026-08-23. These terms cover the property film services sold under the High Season name by Gabriel Homoky, Hungary ("I", "me"). They are written to be read, not skimmed; if anything is unclear, ask before you order.
An order is confirmed when you accept a written quote (an email is fine) and pay the deposit. The quote states the homes, the price, the delivery date and the number of revision rounds. Anything not in the quote is out of scope.
Half of the price is due before work starts, half on delivery of the final files. Card or bank transfer in USD. Prices exclude VAT; for business customers outside Hungary no Hungarian VAT is charged. An invoice is issued for every payment.
You confirm that you hold the rights, or a license, to use the photos, logos and figures you send me for marketing the property, and that I may use them solely to make your films. A film made from a still is a derivative use: many photographers' marketing licenses cover it, some limit derivative or video use. If you are unsure, check the photographer's terms before ordering; I will wait. I do not publish your photos or your films without your permission. Concept samples are the exception: they are built from photos you have already published on your own website, are clearly labeled as samples, sit on unlisted pages that search engines are told not to index, and are taken down within one business day if you ask.
You receive each film in the formats stated in the quote (normally a vertical 9:16 and a landscape 16:9 cut). One revision round is included unless the quote says otherwise. If the first cut is not usable and a revision cannot fix it, the deposit is refunded and the order ends.
On full payment you receive a broad, perpetual, worldwide, irrevocable, royalty-free license to use, copy, edit, distribute and sublicense the delivered films for marketing the homes and your company, and I assign to you whatever copyright subsists in the delivered work. Parts of each film are produced with AI tools; unmodified AI-generated elements may not attract copyright protection in some jurisdictions, including the United States and the European Union, and I do not warrant that you will hold an enforceable copyright in those elements. My production templates, tools and processes stay mine.
The camera motion in these films is generated by a video model from your photographs. Every delivered film carries a short "AI-assisted" line on the end card. You agree not to remove it where disclosure is required by law or by the platform you publish on.
Every figure shown on screen (bedrooms, sleeps, pool, location) is taken from the material you provide or from your public listing. You are responsible for checking those facts before publishing the film.
My total liability under an order is limited to the amount you paid for that order. I am not liable for indirect losses, lost bookings or lost management contracts.
Hungarian law applies. Disputes go to the competent courts of Hungary, without prejudice to mandatory rules that may protect you where you are.
